Wills & Probates
The Law of Inheritance includes Wills & Probate and Estates, and encompasses many important issues for the distribution of property and legacy of the deceased. Klarfeld Law Offices handle all matters pertaining to Inheritance Law including the Drafting and Execution of Wills, Distribution of Estates in accordance with Probated Wills or Inheritance Orders, and/or litigation between heirs and/or those claiming to be heirs of an Estate after the Death of the Legator.

Generally, a person works a lifetime in order to support himself (or herself) and his family and to build a legacy so that he or she can continue to help the family, after his or her demise.
In order to make sure that after his death a Legator’s estate will be divided up between his heirs – in a manner in which he chooses – it is important that a clear and coherent Last Will and Testament be drafted, describing exactly what parts of his Estate the Legator wishes to bequeath to whom after his or her death.
In some circumstances a person accumulates property and assets in the course of his lifetime for which the distribution after death is uncomplicated – even if the person dies Intestate (without a Will). The accumulation of real property, stocks and bonds, cash assets of a moderate amount to be distributed among the only spouse and legitimate children of the deceased may be handled expeditiously whether the Deceased executed a Will or whether he died Intestate – providing of course that the family and heirs choose to do so harmoniously with no claims against the legacies to be bequeathed to the others.
On the other hand, and in many circumstances, either the Legator has accumulated significant assets in the course
of his lifetime, including business, corporations, and properties that have guarantors, liens, promissory notes, or debts to other people or institutions, or, he leaves a complicated and conflicted family behind where there has been strife and conflict, disputed and disputing heirs, and/or spouse, ex-spouse, illegitimate children, and Domestic Life Partners. These are but a few of the circumstances that warrant not only a clearly drafted Will but also the services of an Attorney who specializes in Inheritance Law who can sort out a complicated Estate and or litigate where necessary on behalf of some or all of the heirs.
Furthermore, Israeli law determines who will be heirs and the percentage of their inheritance in cases where a person dies Intestate. However, the proposed Distribution by the Legislature does not necessarily contemplate all the needs of the person who wishes his or her Legacy to be distributed in a different way after death. It might be that he wishes to bequeath part of his legacy outside of his immediate family – to other relatives, good friends, or organizations. It might be that during his lifetime he has made a present of part of his property to a future heir but wishes that the present be considered as part of his Legacy counted as a distribution toward the inheritance of that heir after the Legator’s death.
These are but a few of the issues that face a person regarding the distribution after death of his or her property and assets accumulated over a lifetime.
